REACh

Regulation (EC) No 1907/2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH) and establishing a European Chemicals Agency (ECHA) has been in force since 2007. From the production to the sale of goods, it regu-lates the use and placing on the market of dangerous substances and articles in order to combine a high level of protection of human health and the environment with the com-petitiveness and innovation of chemical and chemical-processing industries in the EU. REACH generally applies to all chemicals, i.e. not only those used in industrial processes, but also those later to be found in items of daily use such as cleaning products or clothes. Therefore, the regulation has implications for most companies throughout the EU - and also for the defence industry!

The regulation is an extraordinarily comprehensive and complex provision. Its central concepts include the precautionary principle and the collection of information on the hazard of a given substance. To this end, REACH addresses commercial actors within the supply chain and traders. REACH assigns the burden of proof to the companies. To com-ply with the regulation, the companies must identify and control the risks, demonstrate the safe use of a substance to ECHA and provide information on risk management measures. The authorities may prohibit dangerous substances or demand their prior authorisation. In the long run, the most dangerous substances should be replaced by less dangerous substances.
